This agreement is designed for the convenience of our residential automatic delivery fuel oil customers only. All heating oil requirements must be purchased from BOYLE ENERGY during the term of this policy. Failure to comply with all of the terms of this policy renders it null and void.

It is also our goal to reward our loyal customer. You will earn $50 in Loyalty Credits each year  you renew your service plan.  You can earn up to $500 in Loyalty Credits during you lifetime as  our customer. Contact the office to see how you can redeem these credits.

BOYLE ENERGY reserves the right to inspect all equipment before accepting such equipment fo Burner Service Plan coverage. Repairs required to place the burner in acceptable condition will be billed at our established rates.

Annual Inspection and Cleaning:

It is the customer’s responsibility to notify BOYLE ENERGY in order to schedule a convenient time for this annual service and to provide safe access to the heating unit. If the customer fails to notify BOYLE ENERGY to schedule this maintenance, it is known that BOYLE ENERGY will not refund any portion of this contract, nor does BOYLE ENERGY have responsibility to perform this maintenance.

Contract Terms:

This contract is automatically self-renewing for each successive year at the rates in effect at the time of each renewal, unless either party shall give 30 days prior written notice of cancellation.  Contracts are due and payable upon presentation and failure to pay within 30 days will results in immediate cancellation (if you are on our budget program you may include the service contract). There will be no refunds of any unused portion of this plan although it may be transferred to new owner, subject to BOYLE ENERGY approval.

Both service plans offer your family comfort and peace of mind year round. Both plans provide you with 24 hour emergency service, parts and labor coverage for no heat and/or hot water calls; also a scheduled tune-up to insure the greatest fuel efficiency.

Liability:

Under no condition are we, BOYLE ENERGY, liable for damage resulting to unoccupied buildings or for damage to their contents, or for any other loss directly or indirectly related to heating system problems of any kind under any circumstances.

It is your duty, at all times, to see that your heater is operating properly, including while you are away from your premises for any period of time, no matter how short this period may be.  It is your sole responsibility to arrange for a daily house check if you are away from your premises.

It is understood that age, deterioration and improper design can cause inadequate draft in your chimney which can adversely affect the operation of your heating equipment. You, (the customer) will hold BOYLE ENERGY, blameless for any equipment failure or damage resulting from the improper or lack of flue venting.

Additionally, under no circumstances will BOYLE ENERGY be liable for damage of any nature resulting from the malfunction or failure of any equipment (whether this equipment is covered under this agreement or not) that is the result of service work performed by anyone other than BOYLE ENERGY service personnel acting without explicit company authorization underwritten company policy.

The company assumes no responsibility to notify any governmental agency, including the Environmental Protection Administration in the event of tank leakage causing any contamination of the earth. BOYLE ENERGY is not liable for any environmental pollution or pollution cleanup due to tank rupture or oil leak of any sort.

This service agreement does not cover service or the repair or replacement of oil burner parts required as the result of abnormal conditions such as war, fire, flood, hurricane, explosion, act of God or other causes beyond the control of BOYLE ENERGY.

The Burner Service Plan includes only repair and replacement of parts which are specifically listed herein which are defective due to ordinary wear. Repairs involving labor or parts not covered under this plan will be billed at our established flat rate.

BOYLE ENERGY shall not be held liable for inability to supply obsolete parts that are no longer available through normal supply channels.  GE and Rotary burners and Blue Ray Burner’s furnaces or boiler will not be covered under this service agreement.  A complete boiler, furnace, oil burner or indirect hot water tank will not be replaced under the terms of this AGREEMENT.

Customers will be charged at our established rates for service calls resulting from: failure of customer to maintain proper water level in boiler, improper settings of thermostat or emergency switch turned off.

*Blower Motors and all related blower components are partially covered in conjunction with air conditioning systems and will be charged at 1/2 the cost.  Please contact us regarding our air conditioning agreement.

Light Commercial and commercial equipment is excluded from this agreement.  Please contact the office for pricing on these systems.

Boyle Energy shall not be held liable for inability of supply obsolete parts that are no longer available through normal supply channels. A complete boiler, furnace, burner, air conditioner or indirect hot water tank will not be replaced under the terms of this agreement.

Customers will be charged at our established rates for service calls resulting from: failure of customer to maintain proper water level in boiler, improper setting of thermostat or emergency switch turned off.

Light commercial and commercial equipment is excluded from this agreement.  Please contact the office for pricing on these systems.
